1.1 Account Creation: You must provide accurate and complete information when creating your Pixyscan account. You are responsible for maintaining the security of your account credentials and all activities that occur under your account.

1.2 Age Requirement: You must be at least 18 years old to use our Service. By using Pixyscan, you represent that you meet this age requirement.

1.3 Account Responsibility: You are responsible for all content audited and data accessed through your account. You must not share your login credentials with others or allow unauthorized access to your account.

1.4 Account Termination: We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

2.1 Permitted Use: You may use Pixyscan to audit websites and web applications that you own, operate, or have explicit permission to test.

2.2 Prohibited Activities: You must not:

• Audit websites without proper authorization
• Use the Service to conduct denial-of-service attacks or overwhelm target servers
• Reverse engineer, decompile, or attempt to extract source code from our Service
• Resell or redistribute our Service without written permission
• Use automated scripts to abuse our API rate limits
• Upload malicious code, viruses, or harmful content
• Interfere with the proper functioning of the Service

2.3 Compliance: You agree to comply with all applicable laws and regulations when using our Service, including data protection and privacy laws.

3.1 Credit System: Pixyscan operates on a credit-based pricing model. Each audit consumes credits from your account balance. Credits never expire once purchased.

3.2 Payment:You agree to pay all fees associated with your chosen plan. Prices are subject to change with 30 days’ notice.

3.3 Refunds: Credit purchases are generally non-refundable. However, we may issue refunds at our discretion for unused credits within 30 days of purchase.

3.4 Failed Audits: If an audit fails due to issues with our Service (not the target website), credits will be automatically refunded to your account.

3.5 Enterprise Plans: Custom pricing and terms may apply to enterprise customers as outlined in separate agreements.

4.1 Your Data: You retain all rights to the websites and content you audit using our Service. Pixyscan does not claim ownership of your data.

4.2 Audit Data: Audit results, performance metrics, and historical data generated by our Service are stored securely and accessible only to you and authorized users.

4.3 Privacy Policy: Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. It sets out exactly what we store from a scan, and what the PixyScan team can and cannot see.

4.4 Data Security: We implement industry-standard security measures to protect your data, including encryption at rest and in transit, access controls, and regular security audits.

4.5 Data Retention: Audit data is retained according to your plan. Free plans retain data for 30 days; paid plans retain data for 1 year or longer depending on the tier.

5.1 Uptime SLA: We strive to maintain 99.9% uptime for paid plans. Our Service Level Agreement (SLA) details specific uptime guarantees and credits for downtime.

5.2 Maintenance: We may perform scheduled maintenance with advance notice. Emergency maintenance may occur without notice to address security or stability issues.

5.3 No Warranty:The Service is provided “as is” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

6.1 Ownership: Pixyscan retains all rights, title, and interest in our Service, including our software, APIs, documentation, trademarks, and proprietary technology.

6.2 License Grant: We grant you a limited, non-exclusive, non-transferable license to access and use our Service in accordance with these Terms.

6.3 Feedback: If you provide feedback or suggestions about our Service, we may use that feedback without any obligation to you.

7.1 Maximum Liability:To the fullest extent permitted by law, Pixyscan’s total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

7.2 Exclusion of Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.

7.3 Audit Results: Pixyscan is not responsible for the accuracy or completeness of third-party websites you audit. Audit results are provided for informational purposes only.

8.1 Right to Modify: We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service.

8.2 Continued Use: Your continued use of the Service after changes to the Terms constitutes acceptance of the modified Terms.

9.1 Termination by You: You may terminate your account at any time through your account settings. Termination does not entitle you to a refund of unused credits.

9.2 Termination by Us: We may terminate or suspend your account immediately if you violate these Terms or engage in prohibited activities.

9.3 Effect of Termination: Upon termination, your right to access the Service ceases. We may delete your data according to our data retention policy.

10.1 Governing Law: These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.

10.2 Dispute Resolution: Any disputes arising from these Terms shall be resolved through binding arbitration in San Francisco, California.

10.3 Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force.

10.4 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pixyscan regarding the Service.
